I fear you may well have received rather questionable advice from your solicitors. May I simply suggest you peruse your Public Liability Insurance policy or perhaps call their helpline and discuss the position. I have no doubt that you will find in the policy some reference to your responsibility i.e. ‘duty of care’, to not knowingly cause, facilitate, permit or condone the existence of risks on the park premises which might result in a claim against your insurers.

Furthermore, I am most surprised that your solicitors did not explain to you your statutory duty under the Occupiers’ Liability legislation for the premises i.e. the park. Having perused your own Public Liability Insurance policy, I respectfully suggest you return to your solicitors and question them in more detail on these points.
